Privacy Policy and general information on the implementation of the data protection requirements set out in Articles 12 to 14 of the General Data Protection Regulation at the State Agency for Roads, Bridges and Waterways of the Free and Hanseatic City of Hamburg.
Almost all citizens and businesses come into contact with the administration sooner or later, for example because they need to apply for an identity card or claim child benefit. This involves the processing of personal data.
In an administrative procedure, data is considered personal if it can be attributed to a natural person, a legal entity (e.g. an association, a corporation), a group of persons or a body of assets. Anonymised or pseudonymised data is not considered personal data.
When administrative authorities process personal data, this means that they collect, store, use, transmit, make available for retrieval or delete this data, for example.

For what purpose do we process your personal data?
The Agency for Roads, Bridges and Waterways (LSBG) processes personal data in order to fulfil the tasks assigned to it.
Examples of processing:
Issuing of permits,
Public participation procedures,
Construction projects
What personal data do we process?
In particular, we process the following personal data:
• Personal identification and contact details, e.g. first name and surname, address, date and place of birth, tax number, identification number, email address, telephone number.
• For the granting of permits, e.g. first name and surname, address, telephone number, email address
• In construction projects and public participation procedures, e.g. first name and surname, address, telephone number, email address
We also collect special categories of personal data, so-called ‘sensitive data’, only if this is necessary for the specific procedure.
In addition, we collect your personal data from third parties where they are legally obliged to disclose it to us. If we are unable to clarify a matter with your assistance, we may also collect personal data relating to you by making enquiries with third parties (e.g. requests for information from your employer, etc.).
We may also process publicly available information (e.g. from newspapers, public registers or public notices).
How do we process this data?
In automated administrative procedures, your personal data is stored and used as the basis for further steps in the administrative process. We employ technical and organisational security measures to protect your personal data against accidental or unlawful destruction, loss or alteration, as well as against unauthorised disclosure or unauthorised access. Our security standards are always in line with the latest technological developments.
Under what circumstances may we disclose your data to third parties?
We may only disclose any personal data that has come to our attention during an administrative procedure to other persons or bodies (e.g. health insurance funds, pension insurance providers) if you have consented to such disclosure or if disclosure is permitted by law.
How long do we retain your data?
The retention period is primarily determined by specific legal provisions. Where no such provisions exist, the retention periods set out in the records management policy apply.
What rights (right of access, right to object, etc.) do you have?
You have various rights under the General Data Protection Regulation. Details are set out in particular in Articles 15 to 18 and 21 of the General Data Protection Regulation.
Right of access
You may request information about your personal data processed by us. In your request for information, you should specify your enquiry to help us compile the necessary data. Therefore, the request should, where possible, include details of the specific administrative procedure and the stage of the procedure.
Right to rectification
If the information concerning you is no longer accurate, you may request that it be rectified. If your data is incomplete, you may request that it be completed.
Right to erasure
You may request the erasure of your personal data. Your right to erasure depends, among other things, on whether the data concerning you is still required by us to fulfil our statutory obligations.
Right to restriction of processing
You have the right to request that the processing of your personal data be restricted. This restriction does not prevent processing where there is an important public interest in the processing.
Right to object
You have the right to object at any time to the processing of your personal data on grounds relating to your particular situation. However, we cannot comply with this if there is an overriding public interest in the processing or if we are required by law to process the data.

If you consider that we have not complied with your request, or have not done so in full, you may lodge a complaint with the competent data protection supervisory authority:

General information regarding these rights
In some cases, we may not be able or permitted to comply with your request. Where permitted by law, we will always inform you of the reason for the refusal in such cases.
However, we will generally respond to you within one month of receiving your request. Should we require more than one month to reach a final decision, you will receive an interim update.
